Overview
Porto is Portugal's second city and a major weekend-break destination, with its tourist life packed into a small area: the Ribeira riverfront, the streets around São Bento station, and the bar strip of Galerias de Paris and Rua de Cândido dos Reis. Like the rest of Portugal, it has decriminalised cannabis possession, not legalised it: a small amount is an administrative offence, while selling and growing are crimes.
What matters most in Porto in 2026 is the street. Groups selling fake "hash" to tourists in Baixa have become more aggressive, and violence in the nightlife district this summer led the PSP to raid the Galerias area.
The Law Right Now
Law 30/2000 makes buying, possessing and using drugs for personal use an administrative offence, up to a 10-day supply. For cannabis, reference doses in Portaria 94/96 put that at about 25g of herb or 5g of hashish. Cases go to a Commission for the Dissuasion of Drug Addiction (CDT), not a court. A non-dependent cannabis user can be fined roughly €25 to €150, or given a warning or another non-cash sanction.
Law 55/2023, in force since 1 October 2023, made more than 10 days' worth an indication of trafficking rather than an automatic crime. If a court accepts the drugs were only for your own use, the case goes back to a CDT.
Selling is trafficking under Article 21 of Decree-Law 15/93: 4 to 12 years in prison, or 1 to 5 years for lesser trafficking under Article 25. Growing cannabis for yourself is a crime under Article 40. Medical cannabis exists only as Infarmed-approved products sold in pharmacies on a special prescription (Law 33/2018).
Porto's supervised drug consumption room, open since August 2022 beside the Pasteleira estate, is a health service for dependent drug users, not somewhere for visitors to use cannabis. In April 2026 the city announced it will move to a larger site on the former Aleixo estate.
Realistic Consequences
A tourist found with a gram or two will typically see the PSP seize it and record their identity, and the case is passed to a CDT. Things escalate if you carry more than 25g, have it split into bags, carry a lot of cash alongside it or are seen handing it to someone. Any of these can turn a CDT referral into a trafficking case under Decree-Law 15/93.
The bigger risk is where and from whom you buy. In a late-August 2026 operation in the nightlife zone of lower Porto, the PSP identified 21 people, detained two and seized 170 doses of cannabis. A tourist buying on Rua de Cândido dos Reis at 2am is standing in exactly that operation's target zone, and is likely to be sold something fake.

Public Sentiment
Decriminalisation itself is not seriously contested: in January 2025 every party in parliament except Chega voted down a bill to criminalise public drug use. In Porto the debate is about public order and harm reduction. The mayor wants more police in the nightlife district; opposition councillors say the consumption-room move was decided without studies. No recent Porto-specific poll on cannabis is available.
Practical Advice for Visitors
Do not treat "decriminalised" as "legal". Possession and use are still offences. Police will seize your cannabis and report you, and there is nowhere in Porto to buy it legally.
Walk away from every street offer around São Bento, Baixa and Ribeira. The "hash" is typically pressed bay leaves, and the crews selling it have threatened and assaulted tourists who said no.
Do not buy in the Galerias de Paris bar strip. It was the target of a PSP operation in August 2026, and the city is pushing for more police there.
Stay under 25g of herb or 5g of hashish, and never share or pass it on. Going over the limit, or handing cannabis to someone else, is what turns an administrative matter into a trafficking investigation.
Do not carry cannabis through Francisco Sá Carneiro Airport. Decriminalisation covers possession inside Portugal only. Bringing drugs in or out is treated as trafficking in Portugal and at your destination.
Stay calm and show ID if the PSP stops you. Arguing, running or refusing ID turns a CDT referral into a detention.
