Overview

Ibiza is Europe's club capital: a small island that fills every summer with visitors heading for the superclubs of Playa d'en Bossa, the bars of Sant Antoni's West End and the port of Ibiza Town. Its party reputation leads many tourists to assume drugs are tolerated. They are not.

The one thing to know: cannabis in any public place in Ibiza is a fine starting at €601, and clubs, beaches and streets all count as public. Every summer the Guardia Civil and Policía Nacional run dedicated anti-drug operations aimed at exactly where tourists go.

The Law Right Now

Spanish national law applies on the island. Penal Code Article 368 makes cultivation, sale and supply a crime but does not cover personal use. Supply carries 1 to 3 years in prison for cannabis, and more for aggravated cases such as organised groups, large quantities or supply to minors, which raise it to 3 to 4.5 years and further in the most serious cases (Arts. 369–370).

Public possession or use falls under Organic Law 4/2015, Article 36.16 (the Ley de Seguridad Ciudadana, known as the "Ley Mordaza").
