⚖️ Legal Status at a Glance — Phuket, Thailand
Overview
Phuket is Thailand's largest island and its most internationally recognised beach destination, drawing millions of tourists annually to Patong, Kata, and Karon Beach. Since Thailand's cannabis decriminalisation in June 2022, Phuket has developed one of the country's most active tourist-facing cannabis markets — dispensaries are concentrated in the Patong and Kata districts, prices run 300–700 THB per gram (~€8–€19), and the commercial infrastructure around cannabis consumption is well established.
Two things cut sharply against this accessibility. First, the beaches tourists come for — Patong Beach, Kata Beach, Karon Beach — are public spaces where cannabis smoking is prohibited and fined. Second, Phuket International Airport is the single most consequential point of legal risk on the island. Every tourist must understand this before arrival: what is legally purchased here cannot legally depart. The market is real; so are the consequences of misusing it.
The Law Right Now
Thailand removed cannabis from the Category 5 narcotics schedule on 9 June 2022. As of April 2026, decriminalisation remains in force across all provinces including Phuket.
Adults 20+ may possess and purchase from FDA-licensed dispensaries. Tourists buy with valid passport ID. Consumption in private spaces and licensed on-site areas is legal.
Public smoking is prohibited on all public land — every beach, street, park, temple, market, and public transport vehicle on the island. Fines reach 25,000 THB (~€650). Bangla Road itself is a public thoroughfare; the dispensaries lining it are private premises. Consumption on the road is prohibited; on-site consumption inside licensed venues depends on each establishment's arrangement.
100-metre exclusion zones around schools, temples, and government buildings are specifically enforced. Phuket has a significant number of Buddhist temples — including several near Patong — and the restriction applies equally to these as to those in Bangkok or Chiang Mai.
Export from Thailand through Phuket International Airport is drug trafficking. Thai law does not distinguish between legally purchased personal quantities and unlicensed product when it comes to export. The act of carrying cannabis through departures constitutes trafficking and carries severe penalties including, for large quantities, the death penalty. This applies to all departure routes from Phuket Airport without exception.
Patong enforcement: Bangla Road sees the highest police presence of any entertainment district in Phuket. Crackdowns are periodic and sometimes intense. Visible public consumption in and around Patong nightlife draws reliable enforcement attention.
📡 Regulation Pulse
- Cannabis and Hemp Bill stalled in Parliament since 2023 change of government; no vote scheduled as of April 2026.
- FDA tightening product regulations for cannabis edibles and concentrates; stricter labelling requirements expected Q3 2026.
- Pheu Thai-led government members have introduced re-criminalisation proposals; industry and agricultural lobbies mounting organised resistance in Parliament.
- Tourism Authority of Thailand developing visitor guidance on cannabis rules; no formal publication date confirmed.
Public Sentiment
Thailand's cannabis industry and agricultural stakeholders are strongly opposed to re-criminalisation. Buddhist conservative groups, some parents' organisations, and portions of the military-aligned establishment are pushing for rollback. The tourist sector is broadly supportive of the current framework. Public polling shows a slight majority favouring regulated access over prohibition, but opinion is geographically split — urban and tourist areas more permissive in attitude than rural and northern provinces.
Practical Advice for Visitors
Buy from licensed dispensaries in Patong, Kata, or Karon. FDA licence must be prominently displayed. Quality licensed shops offer full labelling with THC/CBD content and on-site consumption areas. Prices range 300–700 THB/gram (~€8–€19). Avoid all unlicensed street sellers — no legal protection, no quality assurance.
Never smoke on any Phuket beach or public space. Patong Beach, Kata Beach, and Karon Beach are all public spaces. Fines reach 25,000 THB and police patrol beach areas consistently during peak season. Use dispensary on-site areas or private accommodation only.
Observe the 100-metre temple and school rule. Phuket's temples create exclusion zones in neighbourhoods across the island — not just in the Old Town. This offence is treated more seriously than general public smoking.
Do not buy from anyone on Bangla Road or the beach who is not behind a licensed counter. Unsolicited offers from tuk-tuk drivers, beach vendors, and street sellers are not from licensed sources. Police informant involvement is a documented risk in Patong.
Verify the legal situation before travel. Thailand's cannabis framework is politically contested. As of April 2026 the situation is stable, but check for developments before any trip planned more than two months out.
Do not take cannabis through Phuket International Airport — this is the non-negotiable rule. Consume or discard everything before departing for the airport. Sniffer dogs, X-ray scanning, and manual searches are in regular use. Exporting cannabis from Thailand is drug trafficking under Thai law, with penalties ranging from lengthy imprisonment to the death penalty for large quantities. There are no exceptions and no grey areas at the departures gate.
