Overview
Budapest draws stag groups and festival crowds to the ruin bars of the District VII party quarter — and has one of the EU's strictest drug laws. Hungary criminalises not only possession but consumption itself: a positive drug test is enough for a criminal case, even with nothing in your pockets.
Visitors from Berlin or Prague often assume Central Europe has relaxed. Hungary went the other way in 2025, and although a new government took office in May 2026, the Criminal Code is unchanged.
The Law Right Now
Drug offences sit in Sections 176–180 of the Criminal Code (Btk., Act C of 2012), and cannabis is treated like any other drug. Since April 2025, the Fundamental Law states that the production, use and distribution of drugs is prohibited in Hungary.
Under Section 178(6), consuming a drug, or acquiring or holding a small quantity for your own use, is a criminal misdemeanour punishable by up to 2 years in prison. A small quantity of cannabis is up to 6 grams of total THC — the active content measured by a lab, not the weight of the bag — or up to five plants (Section 461). Above that, possession is 2 to 8 years, and 5 to 15 years for "significant" amounts (over 120 grams of THC).
The escape route is diversion (Section 180): no punishment if you admit the offence, prove at least six months of treatment or a prevention course before the first-instance verdict, and — since the package in force from 15 June 2025 — help police identify the person who sold you the drug. It is available at most twice, and not at all within two years of a previous diversion or drug conviction.
Supply is harsher. Offering or handing over drugs is 2 to 8 years (up to 2 years for a small quantity, even sharing a joint) under Section 176; near schools or to minors it is 5 to 10 years. The 2025 package added asset confiscation, 72-hour detention for people intoxicated in public, and closure of venues where drug crimes occur. HHC has been a controlled drug since 2023. Driving under the influence of drugs is a separate crime under Section 237 (up to 2 years). Medical cannabis exists on paper but is barely accessible.
Realistic Consequences
There is no on-the-spot fine to pay and walk away from. A tourist caught with a gram in a ruin bar or found high during a club raid is taken for a test and becomes a criminal suspect. At the Dojo club in Ötkert in November 2025, police checked 211 people, tested 49 and opened criminal cases against all 16 who tested positive. In summer 2026 a 30-day Budapest operation checked 11,167 people and made 252 arrests, dealers among them.
Diversion means six months of treatment and naming a source — hard for someone flying home next week, so a case can follow you home. Several small bags or scales point towards a supply charge. Being foreign earns no leniency.

Public Sentiment
Hungarians are far more open to medical cannabis than recreational use: a Medián survey of 1,000 adults published in August 2026 found 81% accept doctors prescribing cannabis-based medicines. The new government has promised a new strategy, not legalisation, and street-level policing in Budapest has not softened.
Practical Advice for Visitors
Do not use cannabis in Hungary — not even what you brought from Berlin or Prague. Consumption itself is a crime carrying up to 2 years; a positive test is enough.
Assume any club can be raided. Raids end with drug tests, and cannabis can show up days after use.
Never buy from street sellers or someone approaching you outside a ruin bar. Buying is itself a criminal act.
Do not buy HHC vapes or "legal high" gummies. HHC is a controlled drug, and unlabelled synthetics can put you in hospital.
Do not carry cannabis into or out of Hungary. Import and export are offences under Section 178(1) — including a flight from Budapest airport within Schengen or the train to Vienna.
Do not drive after use. Drug driving is a crime under Section 237, and roadside tests detect cannabis.
If arrested, ask for a lawyer and interpreter, and contact your embassy. Do not sign a Hungarian statement you cannot read.
